"Preventing
the risk of conflicts of jurisdiction in e-commerce: the
targeting with special reference to the technology way"

The notion of risk induces legal responsibility. For the manager of web based
activities, legal risk management includes a prior identification and evaluation
of legal conditions of such activities. Nevertheless, as the Internet reduces
and even abolishes frontiers, this identification and evaluation become nothing
more than an illusion, the relevant legal requirements plunging theoretically
their roots, simultaneously and sometimes in a unsuspected way, in the
legislative corpuses of several States of the globe. This context leads to
inevitable conflicts of laws and jurisdictions, creating legal uncertainties
which the traditional rules of the private international law do not still
succeed in solving. The aim of the present article is to investigate the
approach of "targeting by technology" as an alternative solution. It suggests a
practical definition and evaluates its reception by the substantive law..

growing diffusion of the Internet has given birth to a new type of business
models. In order to know how to manage these new models, we need to
understand the specificities of the different actors on the Web, and
specially the consumer. In this context, the present article treats of
purchases and consumers behavior in cyber-space. The identification of the
factors influencing the consumer buying process helps organizations to
optimize their e-commerce practices and may help the professionals to develop
the optimal tools and standards to satisfy the needs of e-Business market..

The analysis of firm competencies is an important element of
successful strategy. The resource-based view of the firm holds that the
competitive advantage is based on the combination of certain key resources.
From this point of view, a sustainable competitive advantage can be obtained
if the firm effectively deploys these resources in its product-markets. What are the competencies
involved in the business processes that support retail banking such as loans
origination and servicing, risk analysis? It is precisely this kind of
issue that we are going to illustrate through this case
study conducted in the year 2006 in one of the biggest
European retail banking company.

The weak signals are one of the
types of information produced by the Strategic scanning. They take an
essential importance when the scanning is directed "Anticipative
scanning". However, if the weak signals are taken more and more
seriously into account by the persons in charge for companies or for public
organizations, the problem of the exploitation of this type of information
remains of size to be discouraged. Many persons in charge for company
addressed themselves to our laboratory to ask for a methodological help
adapted to their context of work, a help "to measure".
...... We use
a method to
help, at distance, by Internet, the persons in charge to exploit the weak
signals. It is what we call "follow-up at distance " or e-coaching.
A case will be presented in the second part of this communication. We will also expose the scientific lesson
drawn from the follow-up already carried out by our laboratory. |
